ONO Appeals against CGG Seismic

Here is Oceans Not Oil’s appeal submission against the Environmental Authorisation for a proposed 3D seismic survey granted in terms of the National Environment Management Act, 1998 (No. 107 of 1998) (NEMA), as amended, and the Environmental Impact Assessment (EIA) Regulations 2014, as amended, to CGG Services SAS (CGG) (Ref. 12/1/045). The proposed 3D survey would cover an area of up to 9 000 km2 in a 12 750 km2 area of interest located offshore of the Eastern Cape province, roughly between Gqeberha in the east and a point approximately 120 km southeast of Plettenberg Bay in the west.

ONO’s appeal is presented here is in the format required by the Department of Forestry, Fisheries and Environment. It is placed here because many wanted to know how to go about an appeal, which we have spelled out, but here it can be seen clearly.

ONO has requested that the decision to award the Environmental Authorisation (EA) to CGG for a proposed 3D seismic survey (Ref. 12/1/045) be reconsidered and set aside and that all seismic survey operations be suspended, pending the finalisation of this appeal process and any further appeal or judicial review process. It is our contention that the award of the Environmental Authorisation is, inter alia, premature, regard being had to the following grounds of appeal.
